1. Acceptance of Terms

By accessing or using QistLock ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Service. These Terms apply to all users, including business owners, administrators and staff members.

2. Description of Service

QistLock is a financed-device management platform that helps businesses in Pakistan manage installment sales, track customer payments, control financed devices and manage recovery workflows. The Service includes the web application, mobile interface, device agent and related APIs.

3. Account Responsibility

You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activity that occurs under your account.
  • Ensuring that only authorised users have access to your QistLock account.
  • The accuracy and legality of all data you enter into the Service.

4. Acceptable Use

You agree to use QistLock only for lawful purposes related to your financing business. You must not:

  • Use the Service to harass, threaten or harm any person.
  • Attempt to bypass, disable or interfere with QistLock security features or device control mechanisms.
  • Use the Service to manage devices you do not own or have authorisation to control.
  • Resell, sublicense or distribute the Service without written consent.
  • Introduce malware, viruses or any harmful code to the platform.
  • Use the Service in violation of any applicable Pakistani law.

5. Financed Device Management

QistLock allows you to link financed devices to customers and financing plans, and to restrict or restore device access based on payment status. By using this feature:

  • You confirm that you have a valid financing agreement with the customer for each device managed through QistLock.
  • You accept responsibility for all device restriction and restoration actions performed through your account.
  • You understand that device restriction operates at the software level and may not be effective against hardware-level tampering.

6. Limitation of Liability — Device Integrity and Firmware

QistLock provides software-based device management and restriction. QistLock is not responsible for, and shall not be liable for:

  • Hardware hijacking: Any physical or hardware-level tampering, modification or interception of a device by any party, including but not limited to chip-level access, JTAG exploitation, board-level attacks or physical component replacement.
  • Firmware interference: Any unauthorised modification of device firmware, including flashing custom ROMs, modifying bootloaders, exploiting recovery partitions or using advanced tools to alter the device operating system.
  • Advanced circumvention: Use of any technology, technique or method to bypass, disable, interfere with or neutralise QistLock's software-based restriction, lock or agent — whether performed by the device owner, a third party or any other person.
  • Device damage: Any damage to device hardware, firmware or software resulting from unauthorised third-party interference, including but not limited to bricking, data loss or functional impairment.
  • Bypass success: The inability to maintain restriction on a device that has been physically or technically tampered with beyond standard software-level controls.

QistLock's device control features operate at the application and operating system level. Hardware-level or firmware-level interference is outside the scope of our service. Users acknowledge this limitation and accept that determined parties with physical access to a device may be able to circumvent software-level controls through advanced means.

7. Payment and Subscription

QistLock operates on a subscription basis. By subscribing:

  • You agree to pay all applicable fees as described in your plan.
  • Payments are non-refundable unless otherwise stated.
  • We may change pricing with reasonable notice.
  • Failure to pay may result in suspension or termination of your account.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use and protect your data. By using QistLock, you consent to the data practices described therein.

9. Intellectual Property

All content, code, design, logos and trademarks associated with QistLock are our intellectual property. You may not copy, modify, distribute or reverse-engineer any part of the Service without written consent.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, including but not limited to:

  • Violation of these Terms.
  • Non-payment of subscription fees.
  • Abuse of the Service or its features.
  • Legal or regulatory requirements.

Upon termination, your right to use the Service ceases. We may retain your data as described in the Privacy Policy.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free or completely secure. We specifically disclaim any warranty that device restriction will be effective against hardware-level tampering or advanced circumvention techniques.

12. Governing Law

These Terms are governed by the laws of Pakistan. Any disputes shall be subject to the exclusive jurisdiction of the courts of Pakistan.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via the Service or email. Continued use after changes constitutes acceptance of the updated Terms.
